Retired Judge

A retired judge is a judge who has left active judicial service. The legal meaning depends on the court system and the judge's status. In the federal Article III system, an eligible judge may take senior status, creating a vacancy for a new active judge while continuing to hear some cases.

A retired judge is a judge who has left active judicial service. The legal meaning depends on the court system and the judge’s status. In the federal Article III system, an eligible judge may take senior status, creating a vacancy for a new active judge while continuing to hear some cases.

Example: Federal Circuit Judge Raymond C. Clevenger III retired from judicial service on October 2, 2026, after serving as a senior judge for more than twenty years.

Common misconception: Every retired federal judge stops working on cases immediately. Senior judges may continue to handle a reduced or, in some circumstances, substantial caseload.
