Delegated power is authority granted by the Constitution or by a law to a government body or official to carry out specified duties. Congress may delegate implementation responsibilities to agencies, but agencies must stay within the limits of the authority granted and follow applicable procedures.
Example: Congress delegated authority to the Environmental Protection Agency to implement parts of the Clean Air Act, including setting certain air-quality standards under the statute.
Common misconception: Delegated power is unlimited power. The recipient can act only within the scope of the delegation and remains subject to legal and procedural limits.
